How to Pay Child Support With VA Disability

By Mike Broemmel

Veterans disability payments are considered income for the purposes of calculating child support, according to the Department of Veterans Affairs. If you are required to pay child support, you must disclose the full amount of VA disability payments you receive each month. These payments are used to calculate your overall child support obligation.

Determine how much money you receive on a monthly basis through VA disability payments.

Obtain a copy of the state-mandated child support guidelines. These guidelines are available through the clerk of the court where your divorce, paternity or custody case pends.

Calculate your child support obligation replacing regular income with VA disability payments. VA disability payments are equated with regular income, dollar for dollar, when computing a child support obligation.

Enter into an agreed order with the other parent setting forth your child support obligation. If you do not enter into an agreed order with the other parent, the court conducts a hearing after which an order from the court will direct you to pay child support as calculated using the child support guidelines.

Sign off on a voluntary withholding order. Nearly all states require that child support payments be withheld from paychecks and other sources of income. Rarely do jurisdictions permit a person with a child support obligation to drop off or mail in payments. VA disability payments are subject to this type of withholding process.

Consider hiring an attorney to represent you in your child support case. Legal representation ensures that your rights are best protected in this type of proceeding.

The failure to fully and appropriately disclose your VA disability payments could result in the family court sanctioning you in the case involving child support issues. These sanctions can include everything from a monetary penalty to a charge of perjury.
